PROHIBIT SURVEILLANCE PRICE & WAGE SETTING ACT

Summary:

The Prohibit Surveillance Price and Wage Setting Act if passed will prevent the individualized price setting based on surveillance data regarding a consumer and the Individualized wage setting based on surveillance data regarding a worker. Surveillance data is defined as data obtained through observation, and surveillance of consumers or workers and that is related to an individuals personal characteristics, behaviors, or biometrics. Discrimination against a consumer or worker through the use of automated decision would also be prevented.

Highlights:

  • Prohibits individualized price setting that relies on surveillance data, preventing companies from charging different consumers different prices for the same goods or services based on individualized profiling rather than demonstrable cost differences, time-based factors, or publicly disclosed eligibility criteria for discounts.

  • Prohibits individualized wage setting that relies on surveillance data, ensuring workers are not paid different wages for the same work based on undisclosed predictive or behavioral profiling rather than on performance or cost of living.

  • Combats driver exploitation by preventing rideshare companies from using data indicating you are in a financially vulnerable position to offer you lower-paying tasks, knowing you are more likely to accept them.

  • Requires transparency in pay algorithms by mandating that companies using automated systems to set wages must publish procedures and, upon request, inform drivers what data is being used and how it influences their pay.
